Questions about operational and reporting

The information to be received by the Ministry of the Interior to be made available to the National Police and the Civil Guard is as follows:

  • Number and type of the document with which the passenger identifies himself/herself during transport.
  • Nationality of the passenger.
  • Name and Surname of the person to whom the identification document listed in the first paragraph corresponds.
  • The date of birth appearing on the passenger's identification document.
  • The point of origin of the journey that the passenger is making must also be included.
  • As in the previous section, the destination point to which the transport will arrive must also be stated.
  • The corresponding dates of departure and arrival of the transport from the origin of the journey to its destination.
  • The identification code of the company sending the data, also known as "Carrier Code" to identify the company to which the data being received belong.
  • The identification number of the transport.

The Ministry of the Interior must have in its possession the necessary information on the transport to make it available to the National Police and the Civil Guard once the boarding process has been completed and before the departure of the transport to its destination.

Yes, the file that the transport companies send to the Ministry of the Interior must contain, in addition to the data relating to all the passengers that make up the transport, the data belonging to the crew.

Not at all, airlines, maritime and ground companies can send the files directly to the Ministry of the Interior via the secure web service published on the Internet, sftp protocol or via a web page, as explained in the User Manual.

When the information cannot be sent either because the Ministry's Information Reception System fails (Web Application, Web Service or SFTP), or because of a mishap, no power at the airport, no internet connection, etc.

As explained in the resolution, the resolution will enter into force thirty days after its publication in the Official State Gazette, and therefore the start date of the project will be 19 March 2007.

Once the bill comes into force (i.e. from 19 March 2007), there is no trial period for transport companies, they will have to send to the Ministry of the Interior all the data of the transports that are affected by this law.

This project covers all those routes carried out by transports whose origin of route is outside the Schengen area and whose destination is somewhere in Spain.

In these cases, the transport company must send the data concerning the transport, provided that the point of origin of the route is outside the Schengen area and no passport control or similar has been carried out in the transit area.

No. The United Kingdom does not belong to the Schengen area, so all transport from this country is obliged to send the information.

Military aircraft, understood as those whose mission is national defence or are commanded by a military person commissioned for this purpose. These aircraft are subject to their own specific regulations.
Non-military aircraft intended exclusively for non-commercial state services.

  • I (C,A) : National Identity Card and Residence Card. The I must be used, although C and A are accepted.

The passenger will be identified with the document number 9999999.

Minors must travel either with their own passport or with the passport of one of their parents.

Passengers belonging to a group must travel with their own passport.

The date of departure shall be filled in with the local time of the airport/port of departure and the time of destination shall be filled in with the local time of the airport/port of destination.

The modification affects one of the fields currently sent: the IMO code of the ship used in the transport will be replaced by the code of the port of call (the change affects both the name of the file and its content).

The modification is necessary in order to perform the compliance filters without the possibility of error.

In this way we can be 100% sure that the data sent by you matches the data provided by Portel.

At present, comparing using dates, companies and ship codes is not sufficient.

If Portel is not informed in due time and form of changes to the routes or the company that owns or operates the ship and the possibility of non-conformities appearing when comparing with different data.

The aforementioned modification will be effective for notifications made from 1 June of this year.

Questions about penalties and formats

The body in charge of establishing the sanction that will be imposed on the transport company is the Government Delegation, as specified in article 55.2 of Organic Law 4/2000 of 11 January 2007.

For those companies that do not send the data concerning their transports or that these come with a large number of errors, an administrative sanction ranging from 6,001€ to 60,000€ may be applied, as explained in article 55 of the Organic Law 4/2000, of 11 January 2007.

In order to make it easier for carriers to adopt and test the necessary technical measures, until 18 June 2007 the Spanish Ministry of the Interior will notify carriers of any errors or omissions it detects, and will require them to correct them immediately.

During this transitional period, the possible initiation of sanctioning procedures for non-compliance with the measures will take into account the technical difficulties that their implementation may have for the transport companies.

Once this initial period has elapsed, the corresponding penalties may be imposed in accordance with the regulations.

New Registration Forms (Airlines / Shipping Companies).

  • The CNT level 0 field must be mandatory.
  • Group 4 fields LOC and NAT are mandatory. ATT although the format defines it as mandatory we do not need it.

The UNB field specifies the data of the company sending the file and the UNG field specifies the data of the company to which the file belongs.

A manual with the latest specifications of the UN-EDIFACT format will appear shortly.
